In using the website www.UserScout.com the user agrees to have read, understood and accepted all of the terms and conditions ("T&C") and the Privacy Policy. The FAQ is deemed to complement the T&C. In case of a conflict between any document (e.g. FAQ) and the T&C, the T&C will prevail for purpose of the usage of this Website. VIOLATION OF ANY OF THE TERMS BELOW WILL RESULT IN THE TERMINATION OF YOUR RIGHT TO USE THE UserScout WEBSITE, AND ANY ACCOUNT THAT YOU MAY HAVE CREATED AS PART OF THE SERVICE.
UserScout provides users a software as a service to create project pages to recruit participants for their research projects. The main components of the software includes profile matching, user targeting, screening form generation and payment options. UserScout users can easily search and register for projects they choose to participate in.
The software UserScout provides allow users to create their own project recruitment pages providing tools to target, screen and schedule the registered participants. Projects created must be of legal nature and good faith. UserScout has the right to remove any projects that violate the guidelines of UserScout and the country of posting. Questions asked as part of the screening process should be relevant and specific to the projects.
Project organizers have full control in selecting, rejecting and notifying the registered participants. Participants involvement in the project is at th sole discretion of the project organizer and UserScout does not take any responsibilities on the selection, conduct and/or outcome of the project. Project organizers should only contact the registered participants for reasons specific to the projects. To protect registered participants, communication between the organizer and the participant that is flagged can result in the suspension of the project and termination of the project organizer’s account.
Incentives listed on the project pages must be paid out to the participants for participating in the projects unless there is a mutual agreement between both parties for otherwise. Project organizers can state on the project pages the modes of payments and types of incentives. UserScout shall not be held accountable for any disputes between project organizers and participants with regard to paying of incentives.
UserScout gives the option to project organizers to pay cash incentives through the system. Payment should only be made for involvement in projects. Such payments will first have to be made by the project organizer to UserScout before the transaction can be made. In using this service, project organizers must understand that they will have to cover all transaction fees involved. This fee varies depending on the country of the project organiser and the participants.
Participating in projects is fully voluntary. Users should not be forced to provide the project organizer with irrelevant and intrusive information. Users are advised to take precaution when providing information to project organizers. UserScout will not be held responsible for the user’s involvement and participation in third party projects.
UserScout grants the user a limited license only for legitimate access and personal or business use of the Website and the Service. This license expressly excludes any downloading or copying of account information for the benefit of another vendor or any third party; caching, unauthorized hypertext links to the Site and the framing of any Content available through the Website uploading, posting, or transmitting any content that the user is not expressly entitled to by these T&C or any use of data mining or similar data gathering and extraction tools. The user shall not bypass any measures used by UserScout to prevent or restrict access to the Site. Any unauthorized use by the user at the discretion of UserScout shall terminate this license granted to the user.
No user may have more than one active account. Additionally, membership is non-transferable and users are prohibited from selling, trading, or otherwise transferring their account to any other party. If the user does not qualify or read, understand, accept and comply with the T&C, the user may not use the Service or the Website.
In consideration of the user's use of the website, the user hereby represents to be of legal age and legal capability to form a binding contract and not to be a person barred from receiving the Services under the applicable laws or these T&C. Furthermore, the user when registering on the Website agrees to provide the actual, correct and complete information about him or her. If the user does not comply with this provision, or UserScout has grounds to suspect that the user has not complied with this, UserScout at its sole discretion may suspend or terminate the user's account and refuse the user's use of the Website. The user is responsible for maintaining the confidentiality of all personal details relating to the Website (including the user's account and/or password details).
The user hereby agrees to accept responsibility for all activities that occur under the user's account and/or password. The user agrees to notify UserScout immediately of any unauthorized use of the user's account or any other breach of security. UserScout at its sole discretion reserves the right to refuse Service, terminate accounts, or remove or edit content of the Website.
Project organizers reserves the right, at its sole discretion, to refuse or cancel any registration. Such cancellation might be due to limitations on vacancies available, inaccuracies or errors in user’s information, or eligibility and requirements not met by the user. Furthermore, project organizers reserves the right to request for additional verifications or information before selecting suitable participants. The project organizer may contact the user if additional information is required.
UserScout does not claim ownership of any materials the user makes available through the Website but reserves the right to integrate such materials or its modification in its Service. With respect to such submitted materials that the user submits or makes available for inclusion on the Website, the user grants UserScout a perpetual, irrevocable, non-terminable, worldwide, royalty-free and non-exclusive license to use, copy, distribute, publicly display, modify, create derivative works, and sublicense such materials or any part of such materials. The user hereby represents warrants and covenants that the user has the full right to grant the above mentioned license.
UserScout employs a freemium model for the subscription of its Services. Payments are to be made by means of a valid credit or debit card. Users using the free version of the service are not required to provide any credit or debit card details. The UserScout service is billed in advance and all payments are non-refundable. No exceptions will be made. There is no refund or credit for partial months of Service, upgrade/downgrade refunds, or refunds for months used with an open account.
You will be billed on the first day for the first month immediately upon signing up for a paid subscription. you will be billed monthly starting on the 30th day after your account was initially created. An upgrade from the free account to any paying account will end your free trial. You will be billed for your first month immediately upon upgrading. For any upgrade or downgrade in plan level, your credit card that you provided will automatically be charged monthly the new rate. On free accounts, projects will be deactivated once they have exceeded the maximum number of entries allowed for a given month.
All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties. You agree to pay for any such taxes that might be applicable to your use of the Service and payments made by you herein.
UserScout recruitment service is on demand service that is paid per use. Recruitment fees for each successful participant will be agreed upon before the commencement of the recruitment. Payment is to be made once the recruitment is done. Project organizers will be billed according to the number of requested participants through this recruitment service. Payment for unfulfilled numbers will be refunded to the project organizers.
UserScout provides the service of issuing participants their cash incentives through the website. Project organizers will be billed according to the incentive amount and will cover any transaction cost for paying of this incentive.
The type of incentive and amount is based on mutual agreement between the participant and the project organizer. UserScout shall not be held liable for any non-payment of incentives that are not made through the UserScout website. All disputes should be settled between the participants and the project organizer.
All content, and Services on the Website, or obtained from a website to which the Website is linked ("Linked Site') are provided to the user as is without warranty of any kind either express or implied including, but not limited to, the implied warranty of merchantability and fitness for a particular purpose, title, non-infringement, security or accuracy. Other than as required under applicable law, under no circumstances will UserScout be liable for any loss or damage caused by the user's reliance on information obtained through the Website or a Linked Site, or user's reliance on any product or service obtained from a Linked Site. It is the responsibility of the user to evaluate the accuracy, completeness or usefulness of any opinion, advice or other content available through the Website, or obtained from a Linked Site. The user hereby expressly states to understand and agree that UserScout and its subsidiaries, affiliates, officers, employees, agents, partners and licensors shall not be liable to the user for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or any other intangible losses, resulting from the use of the Website, content or any related services. The user agrees to indemnify and hold UserScout (and its officers, directors, agents, subsidiaries, joint ventures, holding companies, affiliates and employees) harmless from any claim or demand, including any attorneys' or other legal fees, or arising out of or related to the user's breach of these T&C, or the user's violation of any law or the rights of a third party.

UserScout reserves the right to investigate and prosecute violations of any of these Terms of Service to the fullest extent of the law which may involve and cooperate with law enforcement authorities in prosecuting users who violate the Terms of Service. UserScout reserves the rights and is at their sole discretion to delete or remove information and material that violates the terms stated in the Terms of Service. UserScout may not monitor, pre-screen the content generated by its users but has the right to do so.
UserScout has the rights and is at the sole discretion to terminate any account that violate the Terms and Service stated. No refunds will be made if the account owner is found to have violated the Terms and Service.
When the user accesses and uses the Website or sends emails to UserScout, the user is communicating with UserScout electronically and consents to receive communications from UserScout electronically, i.e. by UserScout sending emails or posting notices on the Website. Access to and use of password protected and/or secure areas of the Website is restricted to registered and authorized users only. Unauthorized individuals attempting to access these areas of the Website may be subject to prosecution.
UserScout expressly hereby reserves the right to make changes to the Website, its prices, related policies and agreements, these T&C and the Privacy Policy at its sole discretion at any time. Changes to the pricing will be made known 30 days in advance to its paying users. If UserScout makes a material modification to these T&C, it may notify the user by sending an email to the address associated with the user's account. In order to improve possibilities to receive such emails, the user is advised to add UserScout to the list of domains approved to send an email to the user.
Should the user wish to terminate his or her account due to a modification to the T&C or the Privacy Policy, the user may do so by sending an email with the subject line "Termination" to contact [at] UserScout [dot] com. If the user chooses to continue using the Website, the user agrees that by doing so the user will be deemed to accept and be bound by the new T&C or Privacy Policy, as the case may be.
All information and content including any software programs available on or through the Website is protected by copyright. These T&C constitutes the entire agreement between the user and UserScout and governs the user's use of the Website, superseding any prior agreements between the user and UserScout with respect to the Website.
